NSW Rental Advertising and Rent Bidding — Fixed Price Rules
Advertise a fixed price
NSW Fair Trading says residential rental advertisements must include a fixed price. Price ranges, 'offers from' and 'by negotiation' do not comply.
Do not solicit a higher bid
Landlords and agents cannot solicit or invite a prospective tenant to offer more than the advertised rent.
What if a tenant offers more voluntarily?
A prospective tenant may voluntarily offer a higher rent without prompting, and the landlord/agent may consider that offer. The key is that the higher offer was not solicited or invited.
Pet wording also changed
Rental ads cannot state that pets are not allowed. Pet consent is handled through the separate NSW pet-request process.
Management takeaway
Use a clear fixed rent and a consistent application process.
Message MANAGE for compliant rental-marketing workflow.
