Buy Property in Vietnam from Australia — 2026 Guide

Buying in Vietnam starts with buyer status, not the project

Vietnam property can be attractive to Australians, Vietnamese Australians and overseas Vietnamese, but the correct pathway depends on citizenship, residency status, the property type and the specific project.

Thao Pham helps Australia-based buyers organise their brief, compare locations and projects, and connect with appropriately qualified Vietnam-side professionals. ELT Property does not present itself as the Vietnamese legal adviser or the direct selling agency unless specifically authorised for a transaction.

Who this guide is for

• Australians considering a Vietnam apartment or residential property for lifestyle, family or investment reasons.

• Vietnamese Australians and overseas Vietnamese who need to clarify their ownership pathway.

• Foreign buyers who want to understand what must be checked before selecting a project.

• Buyers who want a bilingual Australia–Vietnam contact point rather than relying on random online sales contacts.

What can a foreign individual own in Vietnam?

Under Vietnam's current Housing Law, eligible foreign individuals may own qualifying housing in commercial housing projects that are permitted for foreign ownership, subject to project/location restrictions and ownership quotas.

The law provides a general cap of no more than 30% of apartments in a condominium building for eligible foreign organisations and individuals. For independent houses such as villas and terraced houses, the general cap is no more than 250 houses in an area with a population equivalent to a ward.

A foreign individual's house ownership term is generally up to 50 years from the date of the ownership certificate and may be extended once for up to another 50 years if the legal conditions are met. Different rules can apply to Vietnamese citizens, overseas Vietnamese and foreign individuals married to Vietnamese citizens.

Not every project is available to every foreign buyer. Project eligibility, foreign ownership quota and the buyer's own status must be checked before a deposit or contract.

Your 6-step Vietnam buyer plan

1. Clarify buyer status — Vietnamese citizen, overseas Vietnamese, foreign individual, company or not sure.

2. Define your objective — lifestyle, family use, rental, long-term investment or future relocation.

3. Set the budget and funding plan — purchase budget, payment schedule, currency transfer and cash-flow comfort.

4. Screen locations and projects — focus on legal status, developer, delivery stage, product type, price and whether the project is available to your buyer category.

5. Complete independent legal and transaction checks — buyer eligibility, project legality, contract, ownership entitlement, payment milestones and handover terms.

6. Complete through authorised Vietnam-side parties — the local lawyer, developer/agent and other professionals handle the parts of the transaction that require Vietnam-side authority.

Before paying a deposit, ask these questions

• Am I legally eligible to own this specific property?

• Is the project approved for my buyer category and is foreign quota still available where relevant?

• Who is the contracting entity and who is receiving the money?

• What exactly does the contract give me and when do I receive the ownership certificate?

• What are the payment milestones, late-payment terms and refund/cancellation terms?

• What happens if construction or handover is delayed?

• Which independent lawyer or qualified professional has reviewed the transaction for me?

What is happening in Ho Chi Minh City in 2026?

Current market data shows a market that is active but highly segmented rather than a simple 'everything is booming' story.

CBRE reported only 850 new condominium units launched in HCMC in Q2 2026, down 48% quarter-on-quarter. Savills reports that new HCMC apartment supply remains concentrated in higher-end and luxury segments, with a large share of new luxury supply in the eastern area, particularly Thu Thiem, and along Nguyen Huu Tho Street in the south.

For an overseas buyer, that makes project selection and legal verification more important—not less. Scarcity, premium branding or a strong sales story should never replace due diligence.

What Thao can help with

• Australia–Vietnam buyer briefing and needs discovery.

• English–Vietnamese communication.

• Location and project comparison.

• A question list for developers and selling agents.

• Document and due-diligence checklist.

• Introductions to verified Vietnam-side professionals where appropriate.

• Coordination with Australian professionals if you also need tax, finance or asset-planning advice in Australia.
